LEGAL FEES

Legal Fees are only chargeable by lawyers who are registered to practice law in Malaysia. The fees charged by lawyers are for the following services: 

1.     Prepare documents for the transfer of a property including stamping (please
        refer to the stamp duty rates) and registration.

The fees are based on the value of transaction and the charge is as set out by the schedule below:

2.      Preparation of the charge of a property and attending to stamping and registration – the fees are calculated following the same schedule as in (1). But if the same lawyer prepares the transfer and the charge, as usually is the case, the fees for preparation of a charge is ¾ of the fees in the schedule. The lawyer in theory also charges the bank a fee. But in practice, the borrower also pays this fee. Therefore, it is common for the borrowers to pay 1 ¼ times the rate in schedule.

3.      Loans agreement. The fees are according to the rate given in the abpve schedule. The fee usually includes the lawyer’s service in preparing the charge when the title is ready.

In some complicated cases such as where the property to be bought has no individual title yet, extra documents need to be prepared. The usual ones are as follows:

  • Deeds of assignment

  • Charge in escrow

4.      Miscellaneous charges – this item includes reimbursements for postage stamps, telephone calls, photocopying facilities, etc.

Although the amounts of fees for the major items are controlled, the lawyer may officially give a discount of 25%. Some even give higher discounts to some clients.
